H1B Status/Employment issue

This is regarding my H1B status/employment issue. Here is the situation explained,

First I traveled to the USA on a B2 visa in Jan 2021 (due to no interview slots for F2 Visa) and later in the month of July 2021 I traveled to India, got my F2 VISA done, and traveled back to the USA on F2 VISA in Sep 2021. My Company applied for an H1B Visa in March 2022, and it got picked in the lottery, the filing was done as a change of status (COS) from F2 to H1B in the month of June 2022 and was approved on Oct 21, 2022. Due to numerous reasons (layoffs, project issues, etc.), the company didn’t provide me with a position even after multiple requests until May 2, 2023. Later on, I had to attend and clear the interview with our client and started to work as a Business Analyst for my company starting May 3, 2023, I got my SSN done and was put on the payroll.

In the Month of June 2023, we changed our apartment and had to apply for an amendment for a change of address as the initial filing address was put as Texas instead of North Carolina. The amendment was filed by company in the month of June 2023.

Now I have a problem, The amendment petition went to “RFE” and the USCIS is asking for justification or supporting documents for the period January 2023 to April 2023 (during this period I had no position and payroll, even after multiple requests to the company, they didn’t give me any position). I am clueless about what to do at this moment. Please help.

I request you to please advise me in this situation and also help me with the RFE response.

The employer should have paid you from the start date on your H1B I-797. Once on H1B you cant be without employment and salary as mentioned in the LCA.
You should hire an experienced lawyer and discuss your options.
