H1B petition approved for Oct 2014 ,need some help

You have been helping everyone. Please help me out!!

I got my H1B approved for year 2014 and my Title is Business developement Analyst and start date is Oct 1st 2014 but my current employer wants me to take my H1B transfer to some other company as he does not wants me anymore in the company. I am so stuck,the moment i got my H1B approval he asked me to take transfer and switch. He told me that he will hold my H1B untill i find a new job but have to do it by Sep end:((

Currently my status is CPT. Please help me with the answers:

  1. Can i take H1 transfer from my current company(A) to a new company(B) before starting my H1, i dont have any paystubs as this is my first H1B. My friends asked me not to take transfer as i might get rejection, they asked me to continue with company A for atlest 2-3 months so that i have atleast 2-3 paystubs but my current employer is not willing to rehire me.

  2. Are their any chances of rejection if i take transfer to a new company ( i am still looking for jobs)

  3. What happens if worst cases i get a rejection for transfer to a new company (B), will my H1B will be still valid with company (A). What will be my chances then.

  4. Will company A will know about the tranfer process initated by company B. As i dont want them to know before the transfer is complete.

  5. Please guide me through the process and if there are any DO’S and Dont’s i should take care off.

Below are the answers:

  1. If you have not started your status on H1B, then you can do a transfer without pay stubs. Read , question that starts with “Can I transfer my H1b before October 1…”

  2. If your new company is valid, genuine, there are no rejection chances

  3. Yes, it ll be still be valid with company A

  4. Company A will never come to know about your H1B transfer. USCIS, DOL never reveal this information. Read the FAQs link I sent to you, they will clarify

  5. Tell Company B to initiate the transfer, once done, you can put down papers with company A, serve your notice period and join Company B.

Yes you can transfer your h1b anytime without problems.
