H1B petition approved, can I travel to India and come back on H4

Hi,

I am currently in US in H4 visa and have my H1b petition approved. Now I am planning to visit India for vacation.

Meanwhile my husband had changed companies while in US, so when in India we will have to go for H1b stamping as his company has changed.

My question is :

  1. Can I get H4 stamped again on my passport when I have a approved H1b visa petition?

  2. If I come back on H4 is there anything I need to do after reaching US with regard to my H1b petition

  1. You can get stamped on H4 only if you didn’t apply for COS from H4 to H1.

  2. If you come back on H4 (assuming u didn’t apply for COS), you need to apply for a COS once you come back to US.

Best Option is to contact USCIS. Even the lawyers may mislead you sometimes if they are not well informed.
