H1B - Left US, now want to go back.

Hi guys,

You've been very helpful in the past - so I'm gonna ask for your kindness again:

Short summary of my case: I got an H1B in October 2011. I moved to the US and worked there from December 2011 until October 2013 when I had to quite my job and go home to Europe for some personal matters. I've been home (outside of the US) for about six months and are planning to find a NEW job/sponsor and move back to the US ASAP. My H1B would have had expired in October 2014.

Is my visa technically valid or unvalid?

I've read and heard that I can file for a "Cap-Exemption" - is this true?

If I can file for a "Cap-Exemption" - how complicated is that process once I've found a sponsor?

Can I start at any point or do I have to go through the whole April/October window?

Thanks a lot for your help in advance

Is my visa technically valid or unvalid?

H1B is employer bound. But you can use an al;ready approved petition to transfer to new employer . Max u can stay in US is 6 yrs (with extension)! Apply for cap exempt H1B again
