I am in a dicey situation and need your advice. I applied my H1 extension in Nov 2015 and upgraded to
premium on Jan 7th 2016. My project with the old client completed on Dec 31st 2015 and I have identified
new client as well. As I have been already released from the old client, I cannot furnish the Client letter or SoW.
My new client is ready to share all the documents. Kindly help on how I can proceed now.
Is the new client at a different location than the mentioned in extension petition? When is your current H-1 797 and I-94 expiring?
Hi saurabh, the new client is in different location. The current 797 will expire mid next month
Employer should withdraw current petition and file another one with new location. New LCA needs to be certified as well. As your H-1 has not expired yet, you should be able to get EOS as well. This may cause them to lose money on original petition.
