H1b Expired in Sep 2010 - renewal?

Hi,

HIB visa Stamped in Sep 2007 -
Expired in Sep 2010 -
Stayed in US on H1 from Sep 2007 to June 2008 - around 10 months -
can i renewal H1B - under cap exempt.
i came to know renewal can be done 6 years from date of expired

Please help me…
