H1B ELIGIBILTY

Hi,

I would like to know the eligiblity for H1B, here my case is different and details as follows

BCOM (COMPUTERS) - 2006 - passed out

JAN 2007 - WENT TO UK (JAN 2007 - DEC 2009, Nearly three years I did nothing in UK simply wasted my time by staying on student visa)

Jan 2010 to AUGUST 2011- I started doing MS in one of the good universities @ UK and I finished it up with merit in TIME and my degree is in finance

From 2011 till NOW - which is nearly 2.5 months of IT experience i have and planning to apply for H1B next year so that my EXP will be of 3.4 months. My company is one of the TOP IT companies.

QUESTION: here my question is am I eligible for H1B? Secondly, what I have to say if interviiewer asks me about the GAP between 2007 - 2009 (3 years in UK). I want to be genuine in front of US EMBASSY I do not want to show any fake EXP or I do not want to hide anything about myself.

I think you are eligible for H1B, since you have a MS.

If you do not want to hide anything, just say what you did during that period.

[b]The requirements to qualify for an H1B visa are:

You must have ONE of the following[/b]

1) A Bachelor's degree or Masters Degree (or the foreign equivalent degree from your Country), OR

2) 12 years work experience, OR

3) A mix of further education + work experience


The general H1B visa qualification rule is: 
- for every 1 year of studies at University / College = 3 points
- for every 1 year of work experience = 1 point

12 points in 'total' are required to qualify for the H1B visa program
