H1B Denial for 2014

Hi,

I have filed my H1B in Apr 2014. I received RFE on June 17 and filed the RFE on Sep 13th and it was in RFE response review state for 2 weeks and today ( 2nd Oct 2014) my case is in decision state stating that it is denied and a denial reason will be explained in the letter that will be sent by USCIS. Please let me know chances of approval after I appeal and what is the time i will have to wait to hear the result once I appeal ? Is it really going to take more than 6 months? Somebody please share your experience.I am curently in US on H4. Thank you.

Denial depends on a number of factors but the primary reason is how the RFE was designed. If you choose to appeal, and I think you must, make sure that all points in the letter are addressed accurately and in detail. Appeals can be reversed 90% of the time but not if they have question on the highest level of your education (High School instead of 4 year degree) or something they don’t like regarding employer merit (blacklisting).

MTR can take more than 6 months and does not offer any status. Many times the MTR works so keep fingers crossed

Thank you for replying my post. If i don’t appeal now and again apply H1B next year, will it get through or it is not a good idea to apply immediately next year?
