H1B cap exemt

Hi,

My H1B visa will expired on 30 Sep 2014.I got a project but there is a change of customer,role,project and location.So as per my company,I need to go for Cap exempt (which will take 2-2.5 months in Premium mode and 3-5 months in non premium mode) since there is very less time left for the visa to expire.

I am planning to go on H4(H4 processing is yet to start).

Please let me know which is the best alternative.

  1. Go to US on H4 and search new petitioner/company for getting my cap exempt done and I can work afterwards on changing status from H4 to H1.

  2. Wait in India for 3-5 months to get my cap exempt done.

In my opinion, Opt 2 is a better and sure-shot way to get H1B.
