I got H1B approval in Oct 2008 while staying in US after completing my masters. In Feb 2009, I came back to India for stamping. After H1B stamping, I never went back to US due to personal reasons. From Oct 2008 to Feb 2009, I work only for 2 weeks as contractor and I don’t know my employee ran pay slips for those two weeks. I want to know if I am eligible for cap exempt quota now
To qualify for cap-exempt, the beneficiary need to hold H1B status in last 6 years unless he/she has an approved I140 which is not the case with you so you will need to apply in cap-subject/lottery.
