H1b approved but employer in the violator list

Thanks for the reply for yesterday question, as stated I got h1b approved from a Employer but i never used and it got expired, now the EMPLOYER is in Wilful Violator list. I am applying for h1b from NEW Employer. Please answer the below queries.

  1. Can I become CAP EXEMPT

2)IF I USE OLD PETITION AND NEW PETITION, WILL THERE BE ANY PROBLEM AT COUNSLATE

3)WILL I FACE ANY ISSUES BECAUSE MY FIRST EMPLOYER IS A WILLFUL VOILATOR AT COUNSLATE.

  1. Yes, you are eligible for cap-exempt petition based on your previous approval. Give the copy of previous petition approval notice to the new employer

  2. You will have to carry the petition of the employer you intend to work for. So it will either be new or old but not both

  3. No as you will be going for stamping through new employer and their petition.
