H1B amendment for location change

Hi,

   I had my LCA filed for NJ location and i was working there for sometime. Now i am joining another client in Alabama state and moved to this location. There is no amendment done to my petition as far as i know. Now i am planning to take H4 visa for my wife and son.

I have the following questions

1. Is an amendment of petition required for change of location?

2. I will be giving my new addresss in the DS160 form for my dependents. Will this be a problem for their h4 visa as they will be carrying the I797B issued for my petition which is not amended?

3. I have got an offer from another company which would be filing a new petition in regular mode. Will there be any issues to that petition due to the location change and no amendment being done?

  1. Yes it was required. LCA should change to new location and new LCA triggers an amendment.

  2. You should always complete the DS-160 form truthfully. So do enter the new address. If the officer asks about amended petition, then your dependents should reply truthfully that none was filed. You can ask your employer/attorney about their legal reason to not file the amendment and your dependents can convey that to the officer.

  3. It may or may not be an issue. Discuss this with your new employer’s attorney and maybe they can guide you on what’s the best way to file the cap-exempt petition.
