I have a H1B approved petition until March,2021. My current project got over and I got an opportunity in a different location. However, I am not interested in that opportunity as we need to raise a new amendment request with USCIS. I have another interview scheduled with the same client and same location(which would avoid amendment petition). However, by the time I would get to know the result for this opportunity, my amendment petition would have reached USCIS. Is there a possibility for the employer to withdraw the amendment and LCA so that I can work with the old petition itself if the interview clears.
Yes, your employer/ attorney can withdraw the H1B amendment. Once that is done, you can continue with your current petition. Talk to your attorney, it is pretty straightforward process.
