H1 transfer from India, never travelled to US

Hi,

I got H1B stamped with company ABC and it is valid till September 2015 (17 months more). But I have never been to the USA which means my status has not started yet. Now I want to look out for a new employer who can hire me and take me to the US.

  1. Can the new employer’s petition is suffiient to travel to US? Or do I need to be restampled with the new employer?
  2. If my current employer revokes the current petition, can my new employer still file a new petition after that?
  3. Would any of these things (new employer applying new petition or restamping with new employers name) comes under CAP?

  1. Once your new employer gets the H1B petition approved, you may use the stamped VISA on your passport for travel. You need to make sure that you caryy the new approval notice when you travel.

  2. Yes, the new employer can process a new petition.

  3. New employer can file cap-exempt petition.

My Understanding is little different…

  1. U must go for stamping again, if U have never travelled US on H1

  2. Cap-Exemption is irrespective of revocation/withdrawl

  3. NO
