My H1b is expiring on Sep 6 and my spouse has approved I140. I am applying H4 EAD now in July. How much time it is taking to get the H4 EAD approval. Can I continue working after Sep 6 even if my H4 EAD is pending approval? Can I drive after Sep 6?
Well, it depends on which location you file, it can take few months. Check USCIS website for processing times. You have two things to worry about, one is H4 and second is H4 EAD. With the Biometric process, it is taking much longer. CheckH4 Biometrics Experiences to get an idea. You cannot work after Sep 6 as you will NOT have any authorization. If you can stay on H1B and extend H1B, it is better…otherwise, the delays are a lot with new process for H4.
