Hope you are doing great. I am under great pressure, Please help me out, and here is my scenario.
My current Visa Status is H1B.
My wife came to usa on H4 visa in Nov 2012.
My employer has applied her H1B on April 2013, got query and my employer replied the query and finally her H1B got approved on November 2nd 2013.
Unfortunately her project went to hold because of some budget issues and she was not able to work at client location
By the mean time my employer put her in internal project at employer location (different state from H1B client state). She was on payroll from December 2013.
Recently my employer got query from FDNS (verification of randomly selected H1) regarding my wife H1B petition asking some details like Company name, Employee contact number, strength of company and want to do her interview after at her client location.
My employer has replied the query by stating that she is no more working at client location and she is working at our employer location on another project.
Now we want to get her back to H4 status and current project at employer location will end pretty soon. They also want to revoke her H1B
Please note that we both are with same employer now.
This is my situation and I have some questions regarding this. Kindly help me please
a.) Is it safe to apply her change of status to H4
b.) When can we apply for her Change of status
c.) When can we apply for her h1b revocation
Coming to my case
My H1B valid till 2015, but my employer did not do my h1b amendment after I changed to another client in Jan 2013.
d.) Will my wife change of status will trigger my h1b amendment, then I will be in trouble for not doing h1b amendment and both of us will be at risk.
e.) Does employer change will help me to stay out of trouble in this scenario?
I want to keep my h1b clean and my wife back to H4 status without any trouble. Could you Please Suggest best possible ways to stay safe in this scenario. This will be a great help for me . Thanks you !
