H-1B transfer (job change) just 6 months before extension

Hi,

I came to the US in 2015 on H-1B and my visa is still valid until Aug 2018. Now, I found another job and they are ready to file my H-1B transfer. My queries:

  1. Once they file for the transfer, will get new visa for another three years or it will be valid only until Aug 2018?

  2. Do I still need to extend my visa in Aug 2018?

  3. Will my current employer know once they start transfer process? If not, then when will the matter go to my current employer or when will I have to tell them?

  4. If new employer start transfer process, then can I still chose not go with them and work with my current employer or I will have to accept that job?

  1. Depends on what your new employer states on your petition. If your full time employee and work for no client, you may get it approved for 3 years (not guaranteed, depends on USCIS). If you are going to work for another client through your new employer, the validity will be based off your new client letter.

  2. If you are transferring your visa, you need not apply for extension again.

3)Your current employer will not know. They will only know through you, when you give them notice or put your papers.

4)You can still continue working with your current employer. It is not mandatory, that you have to work for the new employer, just because they applied for transfer.
