GC - Perm Labor in audit - shall I change job

Hi,

My current employer filed my GC - Labour in Aug 2012 and Nov we got reply from USCIS saying its selected in random audit.

My max out date for 6 years on H1 is July 2014.

Any idea how much time it needs to audit cases,so I can file 140 and get extension.

OR

Shall I change my employer and file through some new employer again.

Please help.

Last I checked, it takes 8-10 months for audited cases. This starts from the filing date and not the date of random audit selection.

You and your employer will know the chances of PERM making through the audit. If all the steps were correctly followed (job advertisement etc), then it should be fine. If you have fears, then its better to have a back-up plan.
