Hello
I am on H-1B and applying for H-4. I got my I-140 approved in May 2016 and my employer is not going to revoke it even though I am planning to move to H-4. Just as a side-note, my spouse is on H1B and has an approved I-140.
I have a couple of questions regarding the I-539 CoS form - Part 4 (Additional Information) section
Here they are:
3: Are you, or any other person included in the application, an applicant for an immigrant visa?
4: Has an immigrant petition ever been filed for you or for any other person included in this application?
Are these 2 questions asking about the I-140 (which is approved in my case)? Is the answer “Yes” for both of them if they are indeed referring to I-140?
