I have an advanced degree and the job description matches very well to my bachelor degree. Can we file H1B in advanced degree quota? My attorney says they will file in regular quota as the job matches to my bachelors degree. Last year, the quota was filled on the day my H1B was filed and missed the H1B. I don’t want to loose another time. I am nervous about it. Please advise.
I would agree to the attorney on this. I don’t expect the cap to get over on the first day this year, and so if your attorney can plan to make it reach on the first day, you can make through the cap.
