Extension of H1-B pending: can I travel to US on tourist visa?

Hi there -

I have an H1-B visa issued by company A that expires Jan 31st 2014 - end of this month. I started work for company B last year, and they filed an H1-B transfer petition for me in Aug 2013. The petition is still in 'review' phase as of today.



I have to leave the US for an international work trip on February 24th, by which point I'm hoping my petition would've been approved. My company is okay with me staying outside the country (in London) after this work trip to get my new visa stamp - I can work remotely.



However, I have a close friend's wedding to attend in the US on the 10th of March, and I really, really don't want to miss it 



IF for some reason my petition is still pending with USCIS by the time late Feb/early March rolls around, is it possible for me to travel to the US on my 10-year tourist visa that was issued in 2010? As long as I have a flight booked back to London as evidence, and don't work in the US during my trip for the wedding?



I would appreciate any advice on this matter.

U can go on B1 if the stamp was not cancelled in ur passport…

However be prepared to tell the reason if asked during stamping…

so you think there may be a problem with my visa stamping process if I visit the US in between?

All US Department of State visa stamps are valid on the passport and maybe used for travel until wilfully cancelled or dates are expired. Enjoy the wedding!
