My opt is expiring on April 7 2013 if I my company apply for my h1 on April 2013 would I be eligible for cap gap and work till sep 30th ?
If not what are other options I can continue working ?
If you get the receipt notice of your H1B petition from USCIS within April 7th, you may apply for cap-gap. You will need the receipt number to apply for cap-gap and it cannot be applied after your OPT expires.
If this does not happen, you can stay in USA without employment till you get to know the H1 petition result. If approved, you can work from Oct 1st 2013 only, not before that.
