Eligibility for Cap Exempt

Hi,

Is there any restriction for being H1B Cap exempt on the basis of how old my base/ first petition approval is?

My first petition approval for H1B was on 22nd Jul’15. Since then I got my petition renewed three times but have not traveled to US yet. I got my first H1B stamped just last month on 23rd April’21 on my latest petition. This petition and visa expires on 24th Jul’21.

So I have spent zero days in US even after my first petition approval happening almost six years ago. Can I go for petition extension under cap exempt?

i believe you would be able to reclaim the unused duration of your H1b since you have a stamped visa till July 2021
