EB1, EB2 and EB3 Criteria

Hello

Please let me know who decides whether my case is going to be filed under EB1 or EB2 or EB3?

Is it decided at the time of PWD filing or at what stage?

If my Green Card is filed under EB2, can the same or different employer file my case under EB1 in later date or in future?

Please suggest.

It depends upon the offered GC position and your qualification. Your attorney and employer usually draft the GC position.

If filed as EB-2, it can later be applied as EB-1 as long as you qualify.
