I am unable to travel through L1 visa as my employer has designation constraints for L1-B visa. There is a critical need at onsite & I have to travel. Can my employer then file for my H1 B Premium Visa now? Or H1 B premium quota has any eligibility criteria? Like first H1 B petition has to be registered through lottery or any other pre-requisite condition as such. Basically I want to know in what cases can we file for H1 B premium visa? And can that be separately filed like other visas (H1B, L1A, L1B etc.) or is dependent on some other visa initiation.
Is Premium visa initiated anytime or it has specific time period to start the initiation process?
