Do i need new I797 to apply driving license if the visa transfer is in progress ?

I am on H1B here in Delaware. I need to apply for the driving license. But my Visa is in transfer phase and didn’t receive my new I797. Can I apply the license with old I797 or should I wait to get my new one and apply.
