I would like to know what would happen if the company decides to incur to furloughs. At the moment I have H1B visa but I am in the middle of the green card process. Everything is being done by my employer, as a matter of fact the attorneys just send the Prevailing Wage Request to the Department of Labor.
Unfortunately, H1Bs are not eligible for Furloughs. You need to paid the required wage…If not, they need to find ways to send you back home by paying you required flight fare, etc. That’s the law…Discuss with your attorney…Your green card process is not relevant until you get Green card for furloughs.
