Clock Reset Period

Hi,

I stayed in US from May 26th 2011 to July 31st 2014, which is around 3 years and 2 months on L1B. Returned to India and stayed for more than an year. My H1B got picked in April 2015.I want to travel to US this month. Will I have fresh 6 years in my pocket now or would that 6 years gets counted starting my first visit in 2011? Please clarify. Thanks!

As you physically stayed outside US before start of H-1 term, your clock should be reset. Even if H-1 was applied in April 2015, it cannot start until Oct 2015, which is > 1 year after your L-1 departure date.

So, would that count from my exit from US to the startdate of H1 petition. In my case, this is 14 months.

Dear Saurabh- Just to know on actual clock reset period
Could you please confirm

  1. New H1B filing date should >1 Year from last departure date from USA
  2. New H1B approval date should >1 year from last departure date from USA
    3.New H1B stamping data should >1 year from last departure date from USA
  3. Next landing in USA through new H1B should >1 year from last departure date from USA
