I am currently working with Company A on L1B Visa. My L1 is valid till June 2016. I filed for soft/loose h1b petition which got approved starting from Oct 1, 2014. I could not travel to India to get H1b Stamped so I am still continuing on L1B visa.
I wanted to know if I would be able to join a new employer B with my current approved H1B petition ? If yes then do I need to go to India before I join the new company B.
No, your new company files COS from L to H1B status. From the date that you got the receipt notice of your H1B petition, you are legal to work for your H1B sponsoring company
My wife is studying in Mexico and keep coming to USA. Will that impact my wife status? I think she will not be able to use the L2 VISA. Will she be able to get H4 VISA being in USA or Mexico? I want to avoid travel for her.
If your wife get H4 visa based on your H1, she can travel from any country(mexico or india) into USA. It doesnt matter from which country she is entering into USA for her Visa point of view.
Thanks sir for the answer. No I mean to say if I change my status from L1 to H1 then L2 VISA will not be valid for my wife. She has to move to H4 in order to frequently visit USA. In order to get H4, does she need to go to India to get it stamped ? Can she go to US consulate in Mexico to get H4 based on my COS filed in USA?
Usually first time stamping(of H4 status), she may need to go to home country. Only if the visa is being renewed in the same class and for the same employer(in case of H1) etc, non-home country consulates(like Mexico or Canada etc) would do. Technically, she can apply for visa stamping at any US consulate but such consulate asks her to go to the home country for the first time stamping of a visa in a given class.
