Can we transfer h1b even the approved h1b cancelled without stamping

Hi All,

Got H1b approved,employer is not providing client letter and not interested to send visa interview,only dropbox.where for dropbox no appontments are available.
now they started threating if you dont get dropbox appointment we will cancell h1b.
so can we transfer h1b even the approved h1b cancelled without stamping,they are not providing even approval copy,only we have Receiptnumber and i797c.
Can anyone suggest me on this please?

New employer may file cap-exempt H1B however it is up to the USCIS to approve or deny. Technically your H1B is considered activated if your visa is stamped and/or you worked for the H1B sponsoring employer. However there have been cases where USCIS has approved cap-exempt H1B even if the beneficiary never worked for the sponsoring employer or had H1B visa stamped. So in my opinion there is no harm in trying.
