Can v transfr apprvd h1b (Not yet stamped) to anothr employer?

Hi,

Myh1b petition got approved for 3 yrs in last year cap season and not yet stamped. Seems, I am not gonna get offer from my current employer.

I would like to file h1 cap exempt petition with the help of diff employer and have few doubts reg that.

  1. Whether it can be done while i am in India?

  2. What are the documents which is related to approved petition, i may need to submit to new employer? (I have only receipt/case number with me) will new employer ask approved h1 petition copy (I797 and form I129)?

  3. Is there any risk in applying again with new employer?

  4. Kindly suggest me, how to get new employer to file h1b cap exempt petition?

  5. Please tell me all possible ways of using approved petition.

  2. It is better to have copy of the approved petition. If not, just submit the receipt number and a print-out of online status showing the case as approved.

  3. The petition will be subject to usual H-1 laws and regulations. Nothing more or nothing less.

  4. You will have to find an employer through your own research - network of family and friends, job sites etc

  5. Above is the only way to make use of the old approved petition beside going to work for the old employer.
