Im in kind of a different situation my h1 got rejected my f1 visa expired in May 2012 and my opt is valid through December 2012 I have to go india in November can I come back again if I get admission in school in October apply for Cpt and go to India

You cannot re-enter USA to work if you leave in November. If you did join a school in October and get a CPT before 9 months of your joining, the university is a fake university. You may get into legal troubles in future.
But if you are in OPT and have a STEM (Science, Math, engineering) degree you may apply for 17 month OPT extension and work in USA but cannot use it to re-enter USA as your F1 has expired.
