Can I join new Employer


I got an offer from a company and they started my H1B in normal processing. I don’t like to join now, can that company people file a case or any affect my visa or anything else. I have signed in a document where there are some after joining conditions like " if I resign after before an year I need to pay $2000 as liquid damages". Does signing on company letter head really valid?

They can sue you, but it won’t impact your future immigration prospects.

Usually such contracts are not legal in US but they can sue you in your home country or even pursue the case in US.

Also, my understanding is that when someone is bonded for a year, it means a year from the time they move to company’s payroll. You haven’t joined them yet as your H-1 is in RFE, correct? So you are technically not their employee yet.
