Can i continue with H4 EAD after having H1B approved for 2016

Hi,

Currently on H4 and planned to apply H4 EAD. But, also would like to apply H1B. Can i continue with H4 EAD after Oct1st and convert to H1B when required at later point in time?

Once you got converted to H1B, you cant get EAD since EAD needs H4 for your case.

Your best bet is to get EAD using your H4 for many reasons.

thanks for quick reply. I agree, once i get converted to h1b… can i not hold back converting to H1b until i want to ?

No, you cant put an effective validity date on your petition upon approval. It would be automatically effective up on the approval OR from the date of government proposed(in the case of CAP approvals)
