Can I can apply for H4 visa for my wife without impacting the H1B processing

Hi Folks,

I am currently working on H1B and my wife is in India waiting for H1B approval(it is applied under normal processing). We are not sure about how long it may take to get the approval. Unfortunately her employer is not confident on premium processing. While waiting for the approval she wants to come to USA on H4 visa and convert to H1B after she gets the approval. I am skeptical about applying for H4 visa while H1B is still under processing. Would you please advise me if we can apply for H4 visa for my wife without impacting the H1B processing?

Yes, she can apply for H4 and come over and file a change of status here. Nothing wrong in applying for H4 visa, as you are here in USA, she wont have difficulty in getting H4 approved.

Her change of status filed once here in USA, has to be approved to start working on an approved H1B visa.
