Can I apply H4(not H4 EAD) before 6 months of expiry?

If you don’t apply with H1B you may only apply for renewal within 180 days of expiry.

My visa is stamped till Nov,2023 but I was granted an I-94 at POE until Jan 2023. In the meantime, my spouse has changed an employer but we did not file H4 along with H1B transfer. So can I apply new H4 with new I797 within 6 months of my I94 expiration?

Yes you can in August this year if your current I94 expires in Jan 2023.
