Can H4 of H1b wiht out approved I 140 apply for H1b ?

Hi

I am on H4 Visa and with the new H4 work permit resolution passed, will there be any impact on H4 to H1 conversion.

My spouse is on H1B with out an I 140 ( we have not applied for any green card and have been in USA since couple of months only)
