I am on H1B and is in US for nearly 6 years.I have approved i-140.
I came to India for stamping and hoped to go back before my VISA expires and initiate extension.
Somehow there was some miscommunication and my extension was filed even I am outside US.
So there is no hope that I can go back before June end.
Can my employer withdraw the extension petition and file a cap-exempt petition while I work from India?Can I go for H1B petition with consular processing?
My spouse also has a valid H1B with i-140.
What is my best option to go back to US at the earliest and start working?
Cab somebody please help me on this?
