B-1 to F-2 to H1B

Hi Community

Need advice.

Got 2 visa refusals.(2006; 2012) Got B1 visa then (2012). Changed status to F-2 (since my wife F-1). My baby was born here.
This year got H1B status approved as Software Engineer for a small company. I really need to travel back to my country (not India) and that’s mean that I will need to visit Consulate for Visa Stamping. My wife will go as H4, my baby is U.S. Citizen. Since we were here for 2 yrs as F students we’ve applied for Medicaid and Foodstamps that we receive for my child only. Since we really couldn’t afford this (medical insurance). Although I didn’t have Social Security number I filed Taxes this year (as per IRS everybody residing in U.S. more than 180 days should file taxes to them). Since there was no income, it was empty. Anyhow, we tried to maintain everything legally here.

I’m planning to visit my country after I will start to work and will receive my paystubs. Company’s management is agree with this. Because I will visit company’s sister company in Europe too (so there is business trip in between scheduled).

Does anybody here have had similar or close to this situation? Any advise will be helpful.
My Attorney revised the situation and said that there shouldn’t be any problem with visa stamping.
Thanks for your input.

Sh.
