Arguments for EB2 Category.

Hello Everyone,

My job position is Agile QA Lead. My Job requirement is Masters in Computer Science or equivalent + minimum 3 years of experience.
I have an MBA + 3.5 years of experience. My company’s lawyer are saying that my GC cannot be filed in EB2 category because i don’t have masters in computer science. Is there any argument on the basis of which i can tell them to file my GC in eb2 or i will have to file the GC in eb3 only?

Lawyers have to be adviced on this. You can file in EB2 if the area of employment you are in serves an essential industry category in the United States. Healthcare is top of the list, rest categories such as retail push you toward EB3 unless what you do is helping local economy (County, State).
