Am I eligible for H1B cap exemption? Unused and unexpired H1B petition.

Hello,

As per my understanding H1B is issued in 3+3 year format. My H1B was stamped in Oct/2008 and it has expiry date Sep/2011. I never travelled to US and it is completely unused. Now i have filed thru H1 Cap exempt.

(1) Am I eligible for H1B cap exemption?

(2) If yes, how many years I can get?

(3) Will my dependant get the same time?

  1. U r Cap-Exempt only for few months… 6 Years is cap-exemption period from approval date… so hurry up…
