Am I Cap Exempt ?? Approved H1B- Unused- withdrawal -H4

I came US on F1. My H1B picked and approved in april 2016. My employer had to withdrew my approved H1B before started October ( I didn’t get a chance to work on H1B) due to some complication with client side. My husband filled for H4 and it got approved. Now I wanted to be on H1B.

Q Since my first approved H1B withdrew before it was started ( Didn’t work on H1B), Am I eligible for Cap Exempt?

Yes, you will be eligible under cap exempt. In order to file under cap exempt, you need the receipt number from the previous approval notice.
