365 days for my PERM

Hi,

I am in a big confusion with my 6 year calculation of stay in USA.
Eagerly looking for help

here is my scenerio:

  1. came to US on L1B visa in Feb2011 stayed till Sep2013(since visa expired in sep2013)
  2. applied for H1b visa for the year 2013, got the approval so went to india for stamping on 28 sep 2013
  3. got visa extended till sep2016,came back to US on Jan1st 2014

It means my total stay in US will be:
Feb2011-Sep2013: 31 months
Jan2014-till date(mar2015): 14months
April2015-sep2016: 18months
considering the above data my 6yrs/72 months are completing in May2017

Now since iam planning to applying for my PERM what will be the minimum period I have to apply for perm
also how to calculate the 365 days periods,isit

  1. Sep 2015 since my visa is only valid till sep2016 or
  2. May 2016 since my 72 month is ending May2017

Please provide me your needful suggestions!!

Your present visa could be extended upto a total of 72 months. You apply for extension in-time.
