Hi Experts / Members,
I work for a reputed Indian MNC and we are suppliers to a big shot North American OEM.I was interviewed at the Kolkata consulate on 29th Jan and was approved at that time. Naturally, they kept my passport. But surprisingly I got a call from the consulate after 3 days saying that my VISA has gone under administrative processing and I have to submit the bunch of docs supporting my H1B. I immediately submitted my LCA and original petitions at the VAC as they did not specify exactly what docs they needed. Then Im got a call again after 2 weeks asking for end client letter. Their exact words are:
" request you to kindly submit a letter from your end-client at the nearest VAC center."
My question now is: Does it have to be a letter on my name (like an individual letter) or a common letter from the end client organization inviting the employees from my organization will do? Please clarify.
It is almost impossible to get an individual letter signed from client as it is not as per the policy.
Thanks in Advance !
Your end client letter must have your name reference on the letter. If not, there would be problem in establishing your skill set to the end client’s required skill set. Also at a high level, it would be hard for the immigration officer to establish the Employer-Employee relationship(read more online about it). So, you must have a letter referring you from the client(not a blanket letter with a collective pronoun), it must be a noun and thats you.
Hi Immigeek,
Thank you for your answer. The problem is that my client does not provide a letter on an individual’s name for non-employees / contractors. Although my senior supervisors and upper management (client) are ready to sign it, the legal / HR department does not allow it. In that case, what should i do? Please help ! It is urgent.
Thanks.
In this case, the best you can do is.
- apply for a client letter officially(in email or registered post). Keep a copy of this request.
- If client replies that they cant give such letter to you, take a copy of this reply(email?)
- Write a covering letter to the consulate saying that you have tried to get such letter and client rejected to supply one as per their company rules (attach the above (1) and (2) to that).
- Also attach if you have any recent business correspondence with your client to prove that you are working for the client in the required capacity.
- If you have client office badge, attach a copy too.
In summary, provide all the proofs that you have attempted to get such client letter and client didnt issue.
Good luck.
